Maine Sports Betting Legal History
After some developments in Maine, sports betting was on track for a 2021 launch, and legislators hoped to have operators ready to go for the start of the NFL season on September 9, 2021. After a handful of viable options were considered, State Congress is moving forward with LD 1352, which sets forth some key rules and regulations for sports betting in the state. LD 1352 dictates a $100,000 fee for a 2-year sportsbook license and a tax rate of 16% for online sportsbooks and 10% for retail sportsbooks. Tethering has been added to LD 1352, which requires that online sports betting operators have partnerships with casino providers in the state. Senator Louis Luchini has been a vocal critic of the tethering requirement as it allows retail casinos in Maine to have overwhelming control over the market.
However, the bill came up short and congress will have to try again in 2022. The main worry in 2022 maybe Maine Governor Janet Mills, who will still need to approve any sports betting legislation, and the governor’s approval is less of a guarantee than in other states. In 2019, Mills vetoed a bill for sports betting legislation saying, “while legalized sports gambling may attract some revenue to the state coffers, the same economic premise, in theory, would justify legalizing all forms of gambling: betting on the weather, spelling bees, and school board elections, for instance.” In 2020, Mills vetoed sports betting again, saying there were not enough safeguards for responsible gambling. While Mills has provided plenty of frustrating roadblocks in the legislative process, she has pushed for more consideration of responsible gaming and better preparation for the economy before the state plunges into the sports betting market.
It was originally expected that Mills would have 10 business days following June 18 when LD 1352 was passed in the House and Senate. However, bills in Maine must go through two votes in each chamber, and LD 1352 has only passed through each chamber once so far. Now, the Appropriations Table is tasked with reviewing the bill. The Appropriations Table is a joint committee tasked with reviewing bills that could add to or deduct from state revenue. If the Appropriations Table approves LD 1352, it will be sent to the Senate to pass with minimal opposition. Following this lengthy state process, federal approval will still be needed before the full legal approval of sports betting in Maine.
