Legal History

The majority of progress that has been achieved regarding bill C-218 happened in the last six months of 2021. Although C-218 was presented originally in the House of Commons at the beginning of 2020, it hadn’t moved through the House and Senate until early-to-mid 2021. Once the amendment to the bill took place that decided not to wholly eradicate 207(4)(b) of the Criminal Code, the movement on this bill became very fast.

Support for Bill C-218 was finally garnered after a few failed attempts after adding important legislation regarding horse-race betting. To utilize the newly achieved support, the bill was altered to revise 207(4)(b) of the Criminal Code instead of completely eradicating it. Initially, 207(4)(b) prohibited betting on any single sporting event, fight, race, or athletic contest. The revision positively altered the future of sports betting by expressly legalizing single-game contests.

Royal Assent was recently granted to the bill on June 29, and now there are just formalities to legalize sports betting in Canada. On August 27, Canada passed its new Safe and Regulated Sports Betting Act which allows individual provinces to regulate and operate single-game sports betting on their own terms. Ontario was well on its way to have a fully functional online sports betting market by the end of 2021 — with a launch date set for April 4, 2022.
