Is Sports Betting Legal In Texas?

Sports betting is not legal in Texas. Texas is one of the few remaining large market states that has yet to legalize sports betting.

The 2023 legislative session closed without any movement on sports betting. Since the legislature in the state meets every two years, the soonest sports betting could be legalized is 2025. The most recent bill introduced to the Texas state legislature was HB 1942, which was ultimately shot down.

Meanwhile, daily fantasy sports is legal in the Lone Star State. Social sportsbooks are another way to play here.

  • Sept. 8, 2024: The Dallas Cowboys and Houston Texans open their seasons with wins. The Cowboys topped the Cleveland Browns 33-17, while the Texans dropped the Indianapolis Colts 29-27.
  • July 22,2024: PlayTexas reports that industry firm Eilers & Krejcic Gaming projects the state won’t launch sports betting before 2028.
  • July 22, 2024: The Choctaw Nation is backing proposed legislation to slow casino expansion by the Cherokee Nation neighboring in Arkansas, according to PlayTexas.
  • May 8, 2024: DraftKings CEO Jason Robins says he is optimistic Texas will legalize sports betting in 2025. Robins was speaking on an earnings call.
  • April 3, 2024: Las Vegas and the Texas Destination Resort Alliance file a petition to legalize casino gambling in the state.
  • Feb. 23, 2024: The Dallas Stars strike partnership with PrizePicks, a DFS operator.
  • Jan. 5, 2024: The Las Vegas Sands Corporation has reportedly bought land near downtown Dallas, possibly for casino development.
  • Nov. 29, 2023: The owners of Las Vegas Sands acquired a majority ownership stake in the Dallas Mavericks, potentially paving the way for sports betting discussions in the state. 

Texas Sports Betting Background

During the 2023 legislative session, the Texas legislature had two gambling bills – one for casino resorts (HB 2843) and one for online sports betting (HB 1942) that received House approval.  A resolution proposing a constitutional amendment that would put sports betting to a vote on the November ballot passed the House 100-43. But Lt. Gov Dan Patrick used his power as Senate president to halt the resolution and bills before a Senate vote. “We don’t waste time on bills without overwhelming GOP support,” Patrick said. 

Since then, Mark Cuban has sold his majority stake in the Dallas Mavericks to Las Vegas Sands and plans to build a resort and casino adjacent to the team’s next arena if sports betting can get passed. 

Texas Markets & Sports Teams

Texas would be a key state for sports betting. We have already seen states like New York, Michigan, Ohio, and Pennsylvania embrace legalized sports betting and casinos while Texas remains an outlier. The state could could allow professional sports venues to offer sports betting, and many sportsbooks would be lined up to begin operations in Texas.

Dallas

dallas cowboysDallas is one of Texas’ largest cities and is home to three professional sports franchises. You have the Dallas Mavericks (NBA), Cowboys (NFL) and Stars (NHL). All three have been very competitive over recent years, and the market is also big for those visiting. You also have SMU, located in Dallas, as Texas is loaded with college sports in all the major markets. The Texas Rangers (MLB) are located in Arlington, just outside of Dallas. They recently opened a new stadium and won the 2023 World Series. FC Dallas (MLS) is also just outside the city in Frisco. Mavericks owner, Mark Cuban, has given an endorsement of sports betting, and he is one of the more influential team owners.

Houston

astrosHouston is another major market for sports betting as it holds three professional teams. The Rockets (NBA), Astros (MLB) and Texans (NFL) all play in Houston. The Astros have been a powerhouse in the American League over recent years, while the Rockets are rebuilding. The Texans are resurgent behind star quarterback C.J. Stroud. There are also many colleges in the area including the University of Houston and Rice. Houston also has an MLS team, the Houston Dynamo.

San Antonio

The San Antonio Spurs are rebuilding behind star Victor Wembanyama. San Antonio also has a semi-professional soccer team and has been campaigning for an MLS team.

Austin

If you are in Austin, watching Texas Longhorn football is what you do on Saturdays. The University of Texas main campus is here, and the city also landed an MLS team, FC Austin.

College Sports Betting

The state will have a few options as to how it decides how to deal with college sports betting. Most states do not allow live betting for college sports. It’s unlikely Texas would ban all college sports betting. It could follow what some other states have done and prohibit wagering on in-state schools. With Texas having such a large pool of college teams such as Texas, TCU, Texas Tech, Texas A&M and Baylor. it would make sense to allow wagering on in-state college teams.

While these platforms aren’t sportsbooks, they do allow individuals to win real cash prizes by entering pick ’em contests.
